Travel terms

1. Scope

1.1 These General Travel Terms apply to investor trips and investor programmes run by GreenShield Consulting LLC under the brand Fumba Town Agency (“tour operator”).

1.2 These terms are made available to you (hereinafter “participant” or “traveller”) before booking.

1.3 By booking and paying for your trip, you accept these terms.

2. Conclusion of contract

2.1 The travel contract becomes binding once the tour operator has received the travel price. It is based on the trip description on fumbatown.agency and the tour operator's additional information on the trip, e.g. by email.

2.2 After the contract is concluded, you receive a payment confirmation by email, followed by further emails with all essential details of the booked services.

2.3 The tour operator's pre-contractual information on essential features of the services and travel formalities forms part of the travel contract.

2.4 There is no right of withdrawal.

2.5 All participants must be at least 18 years old at the start of the trip. Younger participants require an individual agreement.

3. Payment of the travel price

3.1 The full price is due immediately when the contract is concluded. Payment is made via Stripe.

3.2 If you have not received the travel documents at least 4 days before departure, please inform the tour operator immediately. We recommend checking the itinerary yourself once received.

3.3 If payments due are not made or not made in full, even after a reminder with a deadline, the tour operator may withdraw from the contract, unless there is already a travel defect at that point.

3.4 Costs for additional services such as visas are not included in the travel price unless expressly stated, and must be paid separately.

3.5 Travel to the destination (e.g. flights) is not included. Accommodation, meals and transfers are only included where expressly stated in the trip description.

4. Changes

4.1 Changes to essential services that become necessary after the contract is concluded and before departure, and that were not brought about by the tour operator in bad faith, are only permitted if they are not significant and do not affect the overall character of the trip.

4.2 The tour operator will inform you of any changes by email as soon as it becomes aware of the reason and, where appropriate, offer you a free rebooking.

5. Cancellation and rebooking by the participant

5.1 The travel price is generally non-refundable.

5.2 If the trip cannot take place due to force majeure, or entry or exit is made considerably more difficult, you can rebook a new trip free of charge. Alternatively, you can use your credit for another service offered by the tour operator, e.g. a consultation.

5.3 If the trip can take place and you rebook yourself, you have a one-time option to rebook to the same trip, another trip or another service of the tour operator. A one-time rebooking fee is deducted from the original amount. If the credit is not sufficient, the difference must be paid separately. Any remaining credit expires. The rebooking fees are:

  • up to 60 days before departure: 20 % of the travel price
  • 59 to 10 days before departure: 50 % of the travel price
  • 9 to 1 days before departure: 80 % of the travel price
  • from the day of travel and in case of no-show: 100 % of the travel price

5.4 In the event of a rebooking, you must choose the new trip within 12 months. Otherwise the trip expires without refund or compensation.

5.5 We recommend taking out travel cancellation insurance.

6. Substitute traveller

6.1 You may declare within a reasonable period before departure that a third party (substitute) takes over your rights and obligations under the travel contract. The declaration is always in time if the tour operator receives it no later than 7 days before departure.

6.2 The tour operator may object to the substitute if they do not meet the contractual travel requirements.

7. Termination and withdrawal by the tour operator

7.1 The tour operator may terminate the contract without notice if the trip is persistently disrupted despite a warning, or if a traveller behaves in breach of contract to such an extent that immediate termination is justified. The tour operator retains the right to the travel price; no refund is made. Any additional costs, e.g. for the return journey, are borne by the person responsible.

7.2 If a minimum number of participants stated in the trip description, the pre-contractual information or the confirmation is not reached, the tour operator may withdraw from the trip by email up to 30 days before departure. If this becomes apparent earlier, you will be informed earlier.

7.3 The tour operator may withdraw from the contract before departure if it is prevented from performing it by unavoidable and extraordinary circumstances. It will declare the withdrawal without delay after becoming aware of the reason.

8. Passport, visa, customs, currency and health regulations

8.1 The tour operator informs you about general passport and visa requirements and health formalities of the destination. No guarantee can be given for their accuracy; the information of the official authorities is authoritative.

8.2 You are responsible for complying with all regulations relevant to the trip. Any disadvantages resulting from non-compliance are at your expense.

8.3 The tour operator is not liable for the timely issue of necessary visas. You must apply for all necessary documents yourself. Make sure your passport is valid for long enough.

8.4 Customs and currency regulations are strictly enforced in many countries. Please inform yourself carefully and comply with them.

8.5 The trips are intended for physically and mentally healthy people. A traveller whose health problems considerably affect the course of the trip may be excluded from the rest of the trip and must bear any additional costs.

9. Confidentiality (Chatham House Rule)

9.1 The Chatham House Rule applies to conversations during the trip: participants may use the information received freely, but may not reveal the identity or affiliation of speakers or other participants.

9.2 Non-compliance may lead to exclusion from future events.

10. Liability

The tour operator is not liable for service disruptions and/or personal injury or damage to property caused or suffered by the traveller, except in the case of gross negligence on the part of the tour operator. Participation in all activities during the trip is at your own risk. We recommend taking out accident and international health insurance.

11. Data protection

Personal data you provide to the tour operator is processed electronically inside and outside the EU to the extent necessary to perform the contract. More information is available under “Legal & privacy”.

12. Legal basis

12.1 The tour operator does not take part in alternative dispute resolution and is not obliged to do so.

12.2 The laws of the U.S. state of Wyoming apply. The place of jurisdiction is Wyoming, USA.

12.3 Claims against the tour operator may not be assigned. This does not apply between travelling family members or members of a jointly registered group.

13. Severability

Should any provision of these terms be or become invalid, the validity of all other provisions and of the travel contract as a whole remains unaffected.
